They were taken to the West Hollywood Sheriff's station at 2.45am where she was booked for public intoxication, while Rutler was charged with driving under the influence.

The L.A. County Sheriff's Department set Rutler's bail at $30,000.

Last month the drink driving case against Christina's man were dropped due to insufficient evidence.

He was not charged after the LA County District Attorney officially rejected the matter.

The authorities ruled that Rutler ultimately had a alcohol level of 0.6 - safely under California's 0.8 limit to drive - and not 0.9 as originally reported, zoodress.com claims.

Christina was a passenger at the time of the arrest early last month and was arrested for public intoxication and was deemed 'incapable of taking care of herself'.

She was not charged with any offence.
